Welcome to Orphsody! These Terms of Service ("Terms") govern your use of the Orphsody website (the "Site") and the purchase of our custom song services (the "Service"). By accessing our Site or placing an order, you agree to be bound by these Terms.

1. The Service

Orphsody provides custom-written and produced digital audio tracks ("Custom Songs") based on stories, details, and prompts provided by the user. Our standard delivery time is 48 hours from the time an order is successfully placed and payment is processed.

2. User Submissions & Content

To create your Custom Song, you will provide us with text, stories, names, and memories ("User Content").

  • You represent and warrant that you have the right to share this User Content and that it does not infringe on the privacy, copyright, or trademarks of any third party.

  • You grant Orphsody a non-exclusive, royalty-free license to use, modify, and adapt your User Content strictly for the purpose of creating your Custom Song.

  • We reserve the right to refuse any order if the User Content contains hate speech, explicit illegal acts, or anything we deem inappropriate for our artists to produce. In such cases, your order will be canceled and fully refunded.

3. Intellectual Property, Ownership & Licensing

This is a critical distinction regarding the music you purchase from us:

  • Orphsody Retains Copyright: Orphsody (and its contributing artists/producers) retains all underlying copyrights, master recording rights, and publishing rights to the Custom Songs created through our Service.

  • Your Personal License: Upon full payment, Orphsody grants you a perpetual, non-exclusive, worldwide license to use the Custom Song for Personal, Non-Commercial use only.

  • What you CAN do: You can play it at your wedding, share it on your personal social media accounts, send it to friends and family, and listen to it forever.

  • What you CANNOT do: You may not monetize the song on platforms like Spotify or Apple Music, use it in paid advertising, sell it, or use it for any commercial enterprise without purchasing a separate Commercial License from Orphsody.

4. Revisions & Refunds

Because our products are highly personalized and delivered as digital goods, all sales are final once production begins. Our policies regarding order cancellations, free factual revisions, and paid creative revisions are detailed fully in our [Link to Refund Policy]. By accepting these Terms of Service, you also acknowledge and accept our Refund Policy.

5. Delivery

All Orphsody songs are delivered digitally via email or a secure download link. We are not responsible for delays caused by incorrect email addresses provided at checkout or emails filtered into your spam/junk folders.

6. Orphsody Promotional Use

We are incredibly proud of the music we make. Unless you explicitly opt-out by contacting us at [Insert Support Email] prior to delivery, Orphsody reserves the right to use snippets of your Custom Song or anonymized versions of the lyrics in our own marketing, social media, and portfolio. We will never share sensitive personal information (like full names or specific private locations) in our marketing without your permission.

7. Limitation of Liability

To the fullest extent permitted by law, Orphsody shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Site or the Service. Our total liability to you for any claim arising out of these Terms or your order shall not exceed the total amount paid by you for the specific order in question.

8. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.
